Divorce should not be your first option. However, should you decide to proceed for a divorce, please refer to the steps for registration for divorce.
Step 1: Download the registration form
here. Complete and submit the registration with a copy of the following documents:
- your child/children's birth certificate(s) (from current marriage and for children below 21 years only) and
- your identity card/valid passport.
Drop the completed form at the drop box outside the main entrance to the Syariah Court. You are not required to make any payment when you submit your registration form.
Your application will not be processed if copies of the supporting documents are not attached or the registration form is incomplete.
Step 2: Attend Marriage Counselling Programme.
You and your spouse will be required to attend the Marriage Counselling Programme with Syariah Court's appointed partner.
Step 3: File Originating Summons.
The originating summons must be served to your spouse, i.e. brought to your spouse's attention.
Your spouse will then be expected to submit his/her Memorandum of Defence, Agreed/Proposed Parenting Plan and Agreed/Proposed Matrimonial Property Plan.
Step 4: Attend Mediation.
The Court's mediator will assist you and your spouse to reach an amicable settlement on the divorce and all the ancillary matters, such as nafkah iddah and mutaah, custody of children and division of matrimonial assets.
If you and your spouse can reach a mutual agreement accepted by the Court, then your divorce can be registered on the same day. Your divorce procedure stops here.
